Terms & Conditions of Sales and Retention of Title

The risk in the goods passes to the buyer on delivery. Ex-warehouse goods shall remain the sole and absolute property of the seller as legal and equitable owner until full purchase price has been paid to the seller together with all the monies by the buyer to the seller.

The buyer acknowledges that it is in possession of the goods solely as bailey for the seller until the full purchase price is paid to the seller with all monies owing by the buyer to the seller.

The seller may, for the purpose of recovery of its goods, enter upon any premises where they are stored or where they are reasonably thought to be stored and may repossess the same.

The contract between the buyer and the seller shall in all respects be construed and operate as an English contract governed by English law.

The seller must be notified in writing of any shortage or damage within three working days of delivery and non-delivery within seven working days of receipt of invoice. Any discrepancies not so reported within the specified period, shall be at the buyers expense and no further liability shall be obligatory on the seller.

All specifically ordered goods shall be solely at the buyer’s expense. Ordering of such goods shall be in writing (or, if verbal order, then confirmed in writing). Also, the seller shall bear no responsibility for the goods being incorrect and full payment will be due within these Terms. Should the buyer wish the seller to take the goods, the buyer shall incur a 15% Restocking Charge to the value of the said goods.

All goods ordered and not collected within One Calendar Month from the date of the order shall be returned to stock and be available for general purchase.

The sellers terms of payment is due 30 days net from the date of invoice. Goods remain the property of Essex Supplies (UK) Limited until fully paid for.

Please read the above Terms and Conditions of Sale and agree that all purchases from Essex Supplies (UK) Limited will be made under these Terms. Alterations form these conditions can only be made in writing to Essex Supplies (UK) Limited.
